Dear Mr. Kirklien,

I am in receipt of your letter dated July 12, 2007. You state therein the Commission will look into this matter.

It was not my intention to submit a series of complaints. My intention was to provide separate instances constituting a single complaint regarding the acts of Judge Adler towards me. In this regard, I requested that the commission withhold any decision until all the possible grievances are presented to your Committee. The Committee has dismissed the complaint for insufficiency before having all my grievances presented to it, much like a jury that renders a verdict before having the entire matter presented to it.

My matters before Judge Adler are ongoing. The last complaint as well as any prospective complaints should be consolidated and the totality of the circumstances must be considered when any examination is made of Judge Adler’s hostility and bias towards me.

Further evidence of Judge Adler’s hostility and bias towards me is found within the present complaint. Judge Adler has dismissed my complaint for libel per se pursuant to C.P.L.R. 3211(a)(7) for failure to state a cause of action when a first year law student knows the test is not whether a party has failed to state a cause of action but whether the circumstances show there is a cause of action. Judge Adler’s incompetence to sit as a Judge is evident. What is not evident are the lengths Judge Adler will go to carry out his personal vendetta towards me.

There is a matter pending before Judge Adler in which I seek the return of escrow monies. Pursuant to the order of Judge John LaCava?, I have served all the Respondents, and they, in turn, have all defaulted. Why Judge Adler is withholding a favorable decision in this matter is incomprehensible to me. Every undisputed act of Judge Adler in this matter evidences his unfitness to sit as a Judge. My right to a fair and impartial hearing will not be denied regardless of Judges like Lester Adler.
