DON’T BE A VICTIM OF SEXUAL HARASSMENT

The law is clear that every employee has the right to a safe place to work free of sexual discrimination. The Congress enacted Title VII of the Civil Rights Laws of 1964 to eliminate sexual discrimination in the workplace. The law provides that it is unlawful for a manager, supervisor or co employee to discriminate against an employee based on sex. The Congress created the Equal Employment Opportunity Commission (EEOC) to enforce the law. The law applies to companies having fifteen or more employees. If the company has less than fifteen employees then the victim’s remedy is to proceed under the State tort law and not under this law. In order to constitute a discrimination based on sex the conduct of the harasser must be severe and pervasive and unwelcomed. The law applies to people of the same sex. If the sexual advances were welcomed then the law does not apply. However, if the sexual advances were welcomed and at a later date the victim demands the sexual contacts to stop and the harasser does not stop a case for sexual discrimination exists. The law provides a victim of sexual discrimination may sue the employer for the sexual discrimination perpetrated upon an employee by their manager, supervisor, or a co employee for money damages. This article offers information of the steps an employee who is a victim of sexual discrimination can take to have the sexual discrimination stopped and seek money damages as well in a court of law.
